1. Introduction

These Terms of Service ("Terms") constitute the agreement between Traxelio ("Company", "We") and you ("User"). They govern your use of our website, application, and GPS tracking services ("Service"). By using the Service, you accept these Terms as well as our Privacy Policy and our Data Processing Addendum.

If you do not accept these Terms, you may not use the Service.

2. Communications

By creating an account, you agree to receive communications from Traxelio (newsletters, offers, service updates). You can unsubscribe at any time via the unsubscribe link in our emails or by contacting us.

3. Purchases and Subscriptions

For any purchase or subscription, you must provide accurate and up-to-date information. Payments are processed by third-party payment providers and are subject to their own terms and privacy policies. We reserve the right to refuse or cancel any order in case of fraud or error.

Our subscriptions are billed monthly or annually depending on the plan you choose. Renewal is automatic unless cancelled by the user or Traxelio. Fees paid are non-refundable except as required by law.

4. Use of the Service

You agree to use the Service in a lawful and responsible manner. It is prohibited to use Traxelio to track vehicles or assets without proper consent, or for any illegal, fraudulent, or harmful activity (spam, phishing, harassment, virus distribution, etc.).

You must have the legal authority or explicit consent from the vehicle or asset owner before activating GPS tracking. Unauthorized surveillance of individuals is strictly prohibited and may result in legal consequences.

In case of violation, your account may be suspended or terminated without notice.

5. Accounts

You must provide accurate information when creating your account and keep it up to date. You are responsible for the confidentiality of your login credentials and for all activity on your account. Notify us immediately in case of unauthorized access.

6. Intellectual Property

The Service, its original content, features, and branding are the exclusive property of Traxelio and its licensors. Any unauthorized use is prohibited.

7. User Content

You are responsible for the content you post on the Service. By posting content, you warrant that you hold the necessary rights and authorize Traxelio to use it to provide the Service. Traxelio reserves the right to remove any unlawful or inappropriate content.

8. Data Protection

Your data is processed in accordance with our Privacy Policy and our Data Processing Addendum. Your data may be processed by third-party service providers as described in the Privacy Policy. We use advanced security technologies to protect your information.

9. Limitation of Liability

The Service is provided "as is" and "as available". Traxelio does not guarantee the absence of errors, interruptions, or data loss. In no event shall Traxelio be held liable for any indirect, special, or consequential damages arising from the use of the Service.

We may suspend or terminate your access to the Service at any time, without notice, in case of violation of these Terms. You may close your account at any time. Provisions relating to ownership, liability, and confidentiality survive termination.

12. Governing Law

These Terms are governed by Senegalese law. Any dispute shall be submitted to the competent jurisdiction of Dakar.
